End User License Agreement (EULA)

1. Introduction

This End User License Agreement ("Agreement") governs your use of the user-generated content (UGC) features in Fitbud ("App"). By using the App, you agree to comply with this Agreement.

2. License Grant

By submitting content to the App, you grant Fitbud a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works of your content.

3. Ownership

You retain ownership of any intellectual property rights in your content. However, you acknowledge that the rights granted to us allow us to use your content to operate, market, and improve the App.

4. User Responsibilities

You are solely responsible for the content you create, submit, or share within the App. You agree not to post content that:

• Infringes any intellectual property or privacy rights.
• Contains hate speech, harassment, threats, or unlawful material.
• Is false, misleading, or deceptive.
• Promotes violence or illegal activities.

5. Content Moderation

We reserve the right to monitor, remove, or restrict access to any content that violates this Agreement or is otherwise objectionable. We are not liable for any loss or damage resulting from such actions.

6. Termination

We may terminate or suspend your access to the App if you violate any terms in this Agreement. You may also discontinue using the App at any time.

7. Disclaimer of Warranties

The App and its content are provided "as is" and "as available" without any warranties. We disclaim all warranties, including but not limited to fitness for a particular purpose, non-infringement, and security.

8. Limitation of Liability

To the maximum extent permitted by law, Fitbud shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages related to your use of the App.

9. Governing Law

This Agreement is governed by the laws of Canada. Any disputes shall be resolved in the courts of Canada.

10. Changes to This Agreement

We reserve the right to modify this Agreement at any time. Continued use of the App after updates constitutes acceptance of the revised terms.
